1.3 If you are not a consumer then you confirm you have authority to bind any business or person on whose behalf you use this website.

3.2 change these Conditions from time to time, and Your continued use of the Website (or any part thereof) following such change shall be deemed to be Your acceptance of such change. It is Your responsibility to check regularly to determine whether the Conditions have been changed. If You do not agree to any change to the Conditions then You must immediately stop using the Website.

3.3 We reserve the right to withdraw any Goods or Services from the Website at any time and/or remove, screen or edit any materials or content on the Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time in our sole discretion. We will not be liable to You or any third party by reason of our doing any of the following: withdrawing any Good or Services from the Website whether or not those Goods or Services have been sold; removing, screening or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

4. ORDERS

4.1 All orders that you place on this website will be subject to acceptance in accordance with these Terms and Conditions.

4.2 All orders are subject to acceptance and availability. If the Goods You have ordered are not available from stock You will be contacted by e-mail or phone (if you have given Us details) and You will have the option either to wait until the item is available from stock or to cancel Your order. All prices are inclusive of VAT at the current rates and are correct at the time of entering information. However, we reserve the right to change prices without prior notice to You.

4.3 The confirmation stage of the process will be the final part. Following this, an e-mail confirmation message will be sent to you to acknowledge that the order has been made. It will detail the products that have been ordered. Please note this is an automated e-mail.

4.4 Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or have cancelled it.

5. PAYMENT

5.1 When an order is placed, immediate payment is required. Payment is requested by PayPal. All major credit and debits cards can be used with PayPal. Payment will be taken from the instructed account.

5.2 Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

5.3 The price you pay is the price displayed on this website at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods you will receive a full refund.

5.4 All prices include VAT (where applicable) at the applicable current rate but will exclude delivery charges, unless explicitly stated otherwise.

5.5 Credit Vouchers:
a) If you have a Credit Voucher issued by us (This will take the form of a private promotional code, it may be used as part payment or full payment towards the total price of the Goods up to the value of the credit voucher excluding postage. All Credit Vouchers must be used in accordance with the Terms & Conditions for that Credit Voucher when issued.
b) Credit Vouchers are valid for a period of one calendar month unless otherwise indicated.
c) Credit Vouchers can only be redeemed against Goods purchased from www.bandicootboutique.com. Credit Vouchers cannot be exchanged for a monetary value, and are non transferable

6. PRICES

6.1 Unless we indicate otherwise, all prices are inclusive of VAT at the current prevailing rates

6.2 Prices are subject to change at any time.

7. RIGHTS TO CANCEL

7.1 If You are purchasing the Goods or Services for private use (i.e. as a consumer as opposed to for business use), You have the right to cancel any contract completed within 7 days of receipt by You of the Goods or Services ("Cancellation Period"). However, You may not cancel any Service ordered from Us once We have started to provide it to You with your agreement. You may not cancel any custom made order, items which are classed as custom made.

7.2 If you do cancel a contract you must:
a) Take reasonable care of the Goods or Services until they are returned back to us
b) Goods must be returned to us in their original condition with all tags intact and all packaging. If any Goods are returned not in original condition and a refund is refused, return postage will be charged to the customer before any Goods can be returned. Where a customer does not wish to pay return postage and or does not wish to have the Goods returned, Goods will be disposed of after a period of 28 days.

7.3 If you do cancel a contract, we will refund the monies you have paid to us within 7 days of you giving us cancellation notice and after the Goods have been returned.

8. DELIVERY

8.1 This website is UK based and hence delivers to customers in mainland UK, Northern Ireland, Channel Islands, Isle of Man, Orkney, Shetland and Scottish Islands. We can also deliver to Europe and also the Rest of the World however the costs of this varies depending on destination. Please see the Delivery Info section for the services offered. All goods must be signed for by an adult aged 18 years or over on delivery.

8.2 We use a recorded delivery service to ensure your item(s) arrive safely and accurately. Delivery within the UK will approximately range from 1 – 2 days. For information on other parts of the world, please view our Delivery Info page.

8.3 We will try out best to ensure your goods are delivered to you within the estimated timescales, however there will occasionally be inevitable delays mainly due to unforeseen circumstances. We shall be under no liability for any delay or failure to deliver the products within estimated time scales.

8.4 Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.

8.5 Bandicoot Boutique cannot be held responsible for any delays caused by but not limited to; Acts of God, industrial action, vehicle breakdown, service providers, credit searches, stock availability and delivery companies. These events are outside of our control and we cannot accept any liability.

9. RETURNS

9.1 The Distance Selling Regulations state that you as a consumer have the right to cancel your full order within seven days of receiving the goods. If you wish to cancel your order you must notify us in writing and return the goods to us within seven days of receipt. When you exercise your right to cancel under the regulations ownership of the goods will revert to us. The Regulations impose a responsibility on you to take reasonable care of any goods that have been supplied.

9.2 You have a duty to restore the goods to us. This means that you make them freely available to us for collection. Any costs incurred by us in collection will be deducted from any refund to you if you fail to organise return of the goods. If you arrange for return of the goods it will be at your own expense. 10. PRIVACY OF INFORMATION

10.1 Any information collected by Us, including that gathered at the time of ordering/registration, is collected lawfully and in accordance with the Data Protection Act 1998.

10.2 We do not sell or transmit any customers personal information, including email addresses, to any organisation for any purpose other than for processing orders placed with us (if necessary).

10.3 Where there is sufficient evidence to suggest that fraud is being perpetrated, (such as the stated name and address being different to that of the credit/debit card owner), We reserve the right to pass identification (such as name, address, email and ISP details) to other businesses, fraud data bases and relevant authorities.

10.4 From time to time We may send You information via email or post regarding your purchase or regarding other services/products available from Us. We would always provide an "opt-out" or "unsubscribe" option in any electronic correspondence to enable you to stop any further mailings if you so wished.
